建设工程合同履行中工程签证的管理及存在的法律问题分析（论文）

随着建筑业市场的飞速发展，建设工程建设中操作不规范的问题不断暴露，一些违法违规现象时有发生，而建设工程合合同履行中工程签证纠纷案件所涉及法律适用的新情况和新问题也比较多，审判实践中因司法理念和对法律精神的理解差异，导致该类案件处理难度增大。对此，文章通过建设工程合同履行中工程签证管理相关理论概述基础上，结合建设工程合同履行中工程签证管理现状探讨建设工程合同履行中工程签证管理现状及存在的法律问题，指出工程签证属性法律界定不明晰，工程签证违约纠纷尚无标准，工程师介入签证管理的依据不足。提出明确工程签证法律属性，制定工程签证违约纠纷处置标准，补充工程师介入签证管理的法律依据的对策。
